Terms of Service
These Terms of Service ("Terms") govern your use of the MoveDrt mobile app and website (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What MoveDrt is
MoveDrt is a marketplace and listing venue that helps users find one another to move bulk earth and construction materials. MoveDrt is not a party to any transaction between users. We do not buy, sell, haul, inspect, weigh, or take possession of any material, and we do not guarantee the quality, legality, safety, volume, or provenance of any material, nor the conduct, identity, or reliability of any user. Any agreement you reach with another user is solely between you and that user.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for everything that happens under your account, so keep your login credentials secure.
3. Your responsibilities
- Provide accurate information in your profile and listings.
- Comply with all applicable laws and regulations, including those governing hauling, weight and load limits, transport, dumping, disposal, environmental protection, and the handling of fill and construction materials.
- Independently verify any material, site, party, and price before acting. Do your own due diligence.
- Be solely responsible for arranging, performing, and insuring any hauling or transport.
4. Acceptable use & user content
You retain ownership of the content you post, and you grant MoveDrt a non-exclusive license to host and display it for the purpose of operating the Service. You are responsible for your content, and you agree not to post anything that is unlawful, fraudulent, misleading, harassing, hateful, obscene, infringing, or that you do not have the right to share.
We have zero tolerance for objectionable content and abusive behavior. We screen listing text automatically, and we provide in-app tools to report content and block users. We may review, remove, or restrict any content, and suspend or terminate any account, at our discretion, particularly in response to reports. We act on high-severity reports within 24 hours.
5. Safety
Moving bulk material involves heavy equipment, vehicles, and physical sites, which carry inherent risk. You are responsible for your own safety and for operating lawfully and with appropriate insurance and permits. Meet and transact prudently.
6. Termination
You may stop using the Service and delete your account at any time in the app (Profile > Delete account). We may suspend or terminate your access if you violate these Terms or to protect the Service or its users.
7. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any listing or user is accurate or trustworthy.
8. Limitation of liability
To the fullest extent permitted by law, MoveDrt and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising out of your use of (or inability to use) the Service or out of any transaction or interaction with another user. Our total liability for any claim relating to the Service will not exceed one hundred U.S. dollars (US$100).
9. Indemnification
You agree to indemnify and hold harmless MoveDrt and its operators from any claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the Service, your transactions with other users, or your violation of these Terms or any law.
10. Governing law
These Terms are governed by the laws of the State of Tennessee, USA, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Tennessee for any dispute that is not otherwise resolved.
11. Changes
We may update these Terms from time to time. We will revise the "Last updated" date above, and your continued use of the Service after a change means you accept the revised Terms.
